Hereinafter referred to as “Buyer” and Debby & Shane Moore of Mohr Whippets hereinafter referred to as “Seller” voluntarily enter into and agree to all terms delineated in this legal, binding contract as witnessed by their true signatures below for the sale and purchase of one purebred dog of the Whippet breed as follows.

Hereinafter referred to as “Puppy” has been sold on a co-ownership to the Buyer
by the Seller as “Show Potential”.
1. Show potential shall be understood to mean that this puppy has no dsqualifying faults according to the AKC Whippet standard evident at the time of sale and further that no genetic disorders are immediately apparent. Should the puppy develop any disqualifying faults as defined by the standard or be diagnosed with any genetic medical disorder attested to by two unassociated veterinarians, thereby causing buyer and seller to agree that the puppy can not be ethically bred, seller, at their discretion, will have two options. a.) should buyer wish to keep the puppy the seller will, after being provided proof of spay/neuter, either issue a partial refund of purchase price or replace puppy with another show potential puppy when one becomes available, full ownership of original puppy would be granted to buyer or b.) should buyer wish to relinquish ownership of the puppy the seller, after receipt of the puppy, will either issue a refund of purchase price or replace puppy with another show potential puppy when one becomes available. All refunds or replacements are st the sellers discretion. Seller shall not be responsible for the development of non-genetically derived disqualifying faults, diseases, or disorders which are due to the buyer’s negligence.
2. If this puppy is a bitch puppy the buyer agrees that the seller will have the right to second pick puppy from a future litter where the bitch is bred to a mutually agreed upon stud by buyer and seller. If this puppy is a dog puppy the buyer agrees that the seller will have the right to two stud services at no charge to any bitch owned, co-owned, or leased by the seller. After the above conditions have been met the co-ownership will end and buyer will obtain full ownership of puppy.
3. Buyer agrees that if puppy is bred that any offspring produced will be placed in proper homes. Pets should be placed with spay/neuter contracts with limited registrations. No offspring will be sold to commercial outlets. Buyer is to obtain seller’s approval of any breedings planned while co-owned with seller prior to breeding occurring.
4. Buyer agrees to assume all expenses associated with showing puppy such as entries, handler, board, etc. Any handler used must be approved by seller.
5. The seller warranties that the puppy is in good health and free of communicable diseases at the time buyer assumes ownership. Seller will provide documentation of current vaccinations, wormings, and other pertinent medical information for the puppy. Buyer agrees to have the puppy examined by a licensed veterinarian within 72 hours of receipt of the puppy. If, as a result of the examination, the veterinarian determines that the puppy is not in good health, than the buyer shall elect to keep the puppy or return it to the seller for a refund. If the buyer elects to return the puppy, the buyer shall within one week after the date of the signing of this contract, send to the seller, a written veterinarian’s certificate stating that the puppy was in ill health when examined. Upon receipt of the puppy, the seller will be obligated to refund all monies received from the buyer towards the purchase of the puppy, and further performance under this contract shall be null and void.
6. The buyer agrees to maintain preventative health care of the puppy including, but not limited to: vaccinations, internal and external parasites, and heartworm medication. The puppy will be fed a good quality food and have access to fresh water at all times. The puppy will not be tied out or chained. The buyer agrees that the puppy will reside in the buyer’s home. Buyer must understand that a Whippet is a sighthound and may run away if given the opportunity. With this in mind, fencing should be adequate to confine the puppy within the yard at all times and it should be on a leash when not in the yard. It is strongly recommended that the puppy be microchipped or tattooed in order to facilitate return if the puppy is lost or stolen.
7. If at any time the buyer can no longer retain possession of the puppy, the seller is to be notified and given first option of resuming full ownership of the dog. Refunds, if any, will be at the discretion of the seller. The dog will be returned with all AKC papers and medical records. Under no circumstances will this dog be sold, leased, traded, or given away to any pet shop, research laboratory, animal shelter, or similar facility.
8. The buyer will keep the seller informed as to the health and well being of the puppy. This feedback is important to future generations. The buyer will notify the seller of any change of address so as to maintain contact throughout the puppy’s life.
9. The buyer agrees that the seller may repossess the puppy upon evidence of neglect and/or abuse at no expense to the seller, and no monies will be refunded.
10. Co-Ownership of said puppy will be granted to the buyer for the sale price of $_______, to be paid in full on or before the puppy is removed from the seller’s premises.
11. There are to be no changes or alterations made to this contract unless both seller and buyer have agreed to them and show so by providing their initials on the original contracts.
12. Buyer agrees that this legal, binding contract will be bound by the laws of the state of Ohio and that any dispute regarding this contract will be settled in the state of Ohio and in the county the seller resides. The buyer is responsible for all court and attorney costs incurred by the seller for any and all noncompliance on the part of the buyer.
13. If the buyer does not comply with all requirements as stated in this contract, seller is relieved of all legal liability.
